These Terms and Conditions govern your use of our website, smarthubsensors.com, and the purchase and use of our products and services. By accessing our website and purchasing our products, you agree to these terms. Please read them carefully.

  3. Products and Services
    1. SmartHub Sensors offers IoT devices, including:
      1. RV Alarm and Monitoring Kit: Available now.
      2. Marine Alarm and Monitoring Kit: Coming soon.
    2. Both products operate via cellular connection and are available with a subscription plan (monthly, biannual, and annual) and a one-time equipment purchase. Additional sensors can be purchased separately. Subscription plans include access to a customizable web-based dashboard and mobile app compatible with Android and iOS.
  4. Warranties and Technical Support
    1. Equipment Warranty: The equipment is warranted for 30 days from the date of purchase against manufacturing defects. This warranty does not cover damage caused by the customer.
    2. Technical Support: We offer free technical support via phone or email for issues related to our products.
  5. Subscription Plans and Billing
    1. Subscription Plans: We offer monthly, biannual, and annual subscription options.
    2. Billing: Subscriptions will be billed according to the selected plan. Additional sensors will be billed separately.
  6. Cancellation and Refunds:
    1. Equipment Refunds: Customers can receive a full refund on equipment if returned within 14 business days in unopened original manufacturer packaging. The refund does not include the shipping cost the customer paid to receive or return the product. Subscription costs paid by the customer will be refunded if no services/data have been used and the equipment is received within the 14-day period.
    2. Subscription Cancellations: Customers can cancel their subscription plan in the SmartHub Sensors app. The subscription will cancel at the end of the paid subscription period. Refunds will not be issued for mid-period cancellations; however, upon cancellation, a subscription will not be automatically renewed. Monthly, biannual, and annual subscriptions are auto-deducted using the current payment method on file based on the most current subscription selection.
  7. Data Security and Privacy
    1. We are committed to ensuring the security and privacy of our customers’ data. To this end, we employ robust security measures, including end-to-end encryption, to protect your information.

Except for your informational, personal, non-commercial use as authorized above, you may not modify, reproduce, or distribute the content, design, or layout of the Service, or individual sections of the content, design, or layout of the Service or SmartHub Sensors logos without our express written permission.

    1. SmartHub Sensors reserves the right to modify the Service, and the rules and regulations governing its use, at any time. Modifications will be posted on the website, and users are deemed to be apprised of and bound by any changes to the Service. SmartHub Sensors may make changes in the products and/or services described on the Service at any time.
  11. Links
    1. From time to time, we may post links that will allow you to leave the User Interfaces and, in the future, we may offer links that will allow you to leave the Services. The linked sites are not under the control of SmartHub Sensors, and the content available on the sites linked to the Service do not necessarily reflect the opinion of SmartHub Sensors. SmartHub Sensors is providing these links as a convenience to you, and access to any other sites linked to the Service is at your own risk. SmartHub Sensors assumes no responsibility for the content of such linked sites. The inclusion of any link does not imply a recommendation or endorsement by SmartHub Sensors of the linked site.
  12. Customer Agreement for Use of Product and Services
    1. You may access and use the SmartHub Sensors product only with an official SmartHub Sensors Solution that is authorized to connect to the SmartHub Sensors product, and you agree not to tamper with, alter, or otherwise modify your SmartHub Sensors Product or SmartHub Sensors Solution. An example of this is removing the SmartHub Sensors supplied SIM card within the SmartHub Sensors Product and attempting to use that in a third-party device. By using the SmartHub Sensors Product and Solution, you agree to receive all software updates, notifications, and services that SmartHub Sensors provides to your SmartHub Sensors Solution either directly or indirectly. Each time your SmartHub Sensors Product accesses the SmartHub Sensors Dashboard or App, you acknowledge and agree that you are a user of the SmartHub Sensors Products and SmartHub Sensors Solutions/Services and are bound by these Terms of Use.
    2. Notwithstanding anything to the contrary in these Terms of Use, the Parties retain the absolute right to immediately suspend or terminate your access and use of the SmartHub Sensors Solutions/Services provided as part of the SmartHub Sensors Product if you breach any provision in these Terms of Use, you discontinue the required data service of the connected SmartHub Sensors Product, if you misuse the SmartHub Sensors product or solution/services, and/or if you alter your SmartHub Sensors Product, or use the SmartHub Sensors Product or Solution/Services in such a manner as to infringe upon the intellectual property rights of SmartHub Sensors or any third party or as to violate any applicable law.
    3. The Parties reserve the right at any time to modify or discontinue, temporarily or permanently, the SmartHub Sensors Solution/Services (or any part thereof) with or without notice. You agree that the Parties shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the SmartHub Sensors Solution/Services.
  13. Apple and Android Devices
    1. The following terms apply when you use the SmartHub Sensors App obtained from either the Apple Store or Google Play (each an “App Distributor”):
    2. the terms are an agreement between you and us, not with the App Distributor.
    3. the license granted to you for the App is limited to a non-transferable license to use the App on a device that utilizes the Apple iOS or Android operating systems, as applicable, and by the usage rules outlined in the applicable App Distributor’s terms of service;
    4. We, not the App Distributor, are responsible for addressing your or any third-party claims relating to the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. These Terms do not limit our liability beyond what is permitted by applicable law.
    5. We are responsible for providing any maintenance and support services with respect to the App as specified in these Terms or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services for the App;
    6. In the event of any third-party claim that the App infringes that third party’s intellectual property rights, we, not the App Distributor, are solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim;
    7. In the event of any failure of the App to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the App;
    8. You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country and (ii) you are not listed on any U.S. government list of prohibited or restricted parties;
    9. You must comply with applicable third-party terms of agreement when using the App, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the App; and
    10. You acknowledge and agree that the App Distributors are third-party beneficiaries of these Terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
  14. Indemnification
    1. You agree to defend, indemnify, and hold harmless Forza Technologies, Inc dba SmartHub Sensors, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Solutions/Services/ Product, including any use of the website’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the website.
  15. Security
    1. You are responsible for maintaining the confidentiality of your login and password, and you are responsible for all uses of your login, password, and PINs, and any and all related charges, whether or not authorized by you.
  16. Limitation of Liability
    1. Your use of the Solutions/Services/ Product is at your risk. Forza Technologies, Inc dba SmartHub Sensors will not be liable for any damages including direct, indirect, incidental, consequential, or punitive damages, arising out of your access to or use of the Solutions/Services/ Product and however caused, whether in contract or tort. If you become dissatisfied in any way with the Solution/Services/Products or its Terms or Privacy Policy, your sole and exclusive remedy is to stop using the Solution/Services/Products and its services. If any portion of these limitations on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of Forza Technologies, Inc. dba SmartHub Sensors shall not exceed one hundred dollars ($100).
